The Geary Act

Geary, a democrac in congress made a bill that was related to Chinese immigration, it was a passport system for all Chinse people living in the United States by making them apply and carry a certificate saying that they live in the United States. If the chinese residents were found without their certificate they would be deported or arrested and have to be worken hard. There wouldn’t be any bail to Chinese which were involved with habeas corpus and Chinese witnesses’ statements wouldn’t be allowed to be present in court. Chinese americans and Chinese Americans denounce the Geary Act, but the United States Sumpreme Court agreed with it and upheld the Gear Act in 1893. In the Geary Act of 1892 in section two it says “any Chinese person or person of Chinese descent, when convicted and adjudged under any of said laws to be not lawfully entitled to be or remain in the United States, shall be removed from the united states to China, unless he or they shll make it ppear to the justice, judge, or comissioner before whom he or they are tried that he or they are subjects or citizens of some other country, in which case he or they shall be remoeved from the united states to sch country.” In layman’s term this is saying that any person that has a Chinese ancestery they would be convicted and judged if they’re not supposed to be in the United States and would be transported to China if they don’t have any proof of being from somewhere else. In SEC. 4. of the Geary Act “That any Chinese person or person of Chinese descent convicted and adjudged to be not lawfully entitled to be or remain in the United States shall be imprisoned at hard labor for a period of not exceeding on e year and thereafter removed from the United States, as here in before provided.” It says that any person with Chinese ancestry arrested would have to be subdued to hard labor unless s/he did something good like community service. The act is aimed at Chinese immigrants it was made by Thomas J. Geary the consequences of it is that Chinese immigrants can’t go out on the streets without being stopped and asked for their certificate and if they don’t have it they’ll be haled off to jail. My person response to the Geary act is that the congressmen shouldn’t be that prejudice because if he wasn’t why he would only exclude the Chinese and not other races like his own for instance?

The "Geary Act" is mainly aiming at the chinese immigrants. This act is talking about how the immigrants are suppose to bring their papers or certificates with them at all times to show that they are proper citizens. If they don't have the papers with them, they are immidetialy send back to china or face one year of hard labor. If an chinese immigrant commited a crime in the US they are judged in America depending if they should be send back to china or not for the crime. The creator of this act is Thomas J. Geary and this act is named after him. The consquences of these acts are that they face returning to their country with no money, or face one year of hard labor. If they are commited in a crime they cannot be bailed and waits for the judge to summon him. I think that this law is unfair to the chinese immigrants. They came to America to find a better life and support their families back home but instead face discrimnation and they have to bring their papers everywhere just to show that they are American citizens. If they don't have their papers they are being commited a crime and being send back to china.

In the Geary Act, the aim is towards Chinese Immigrants or Chinese people. This happened during 1892, and this is an act to stop some of the Chinese people from coming into the United States. The senate, and the House of Representatives create this act. In this act it says that if a Chinese person were convicted of any laws that has been written, then they would need to be sent back to china, also the person who was convicted would need to remain in the United States and be in prison at hard labor for less than one year, then they would be removed from the United States. They could only stay if the person gave any proof that would satisfy the judge, and then they were able to stay. If the person replaced their name that was written on the certificate to another name, they would be fined for no more than one thousand dollars or they would be in prison/jail for no more than five years. The consequences that this act has is that if the person did any of the things on the Geary Act that they were not supposed to do, then they would either be fined or they would be sent to jail for some amount of years. After I had read what the Geary Act was, I didn¡¦t like one bit of what was written, the senate and the House of Representatives wrote was like they made all these rules or laws to stop many of the people who was coming here to make money go back to China. It seems like they made all the laws relating back to what many of the Chinese came here for.

This act was made by the goverment of U.S approved on May 5,1892. this law was passed to keep chinese immigrants from coming to the U.S. Anyone chinese immigrant to come to american was deported and had to pay a tax as condion of the removal. Some chinese immigrants where imprisioned for being unlawful. This law also was aimed at anyone who was a decendent of any chinese immigrants. Any chinese immigrant who canghes their name of uses a sub for their name or knowingly forged thier certificate would "be guilty of misdemeaner and will be fined one thousand or immprisoned for five yaers. they would also have to pay one dollar for each certificate.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That all laws now in force prohibiting and regulating the coming into this country of Chinese persons and persons of Chinese descent are hereby continued in force for a period of ten years from the passage of this act…
This act said that Chinese immigrants who were arrested in this country and found to be illegal would be imprisoned or sent to another country from which they had been citizens when they were found.
Legal Chinese immigrants that failed to report to the Internal Revenue Service and to pay taxes with the first year of living in this country would be deported from the United States as and illegal alien and not permitted to return.
If the immigrant lost their documents or they were taken from them by someone who had a grudge the law said that they would be imprisoned or deported from the country, too. These laws not only covered Chinese immigrants but mixed Chinese too and the regular citizens had to carry their documents with them at all times to prove that they were already here when the law was passed.
Collecting taxes and penalties became another way to control the Chinese immigrant and many who had come here before had jealousies over the fact that these people worked so hard for so little so these laws permitted them to get rid of anyone who may take their jobs and incomes from them. I think that history should explain more about how not only the Africans were slaves through these laws but many other nationalities and races were too.
This Act is similar to the Chinese Exclusion Act. It was created by the Senate, the House of Representatives, and The Secretary of the Treasurey. It was enforced in 1892. This Act is aimed at the Chinese, not allowing them to come to America. This Act is to continue for 10 years. If the law said that they cannot stay in America, then they will be sent back to China or imprisoned and work for a certain amount of years and then be sent back to where they were from. The immigrants has to apply for a certificate of residence to stay in America, any Chinese who doesn't have one will be sent to where they were from or put in prison by the order of the court. The Chinese needs to have a reason for not having a certificate, reasons that are valid are if they were in an accident, they were sick, or in an unavoidable situation and there has to be a white witness.
